Summary/Abstract: The right of each child to grow up in the family is a fundamental right. Placing a child to a care institution is based on specific circumstances. After the war, it happened because the child's parents were dead, emigrated or deported. However, the fact that nowadays there is such a large number of childcare institutions in Latvia obliges the state to seek a solution for the realization of children's rights. The UN Committee on the Rights of the Child has developed recommendations for providing children who are out of the family with the opportunity to grow in a family or in a similar environment. For Latvia, the Ministry of Welfare of the Republic of Latvia has elaborated an action plan for the implementation of deinstitutionalization in 2015-2020. De-institutionalization is the creation of a service system that provides a person with limited self-care possibilities with the support they need to live at home or in a family environment. An important part of this plan is to guarantee that every child grows up in a family. The problem consists in the preventive work with families, so that the number of children removed from the biological families can be drastically reduced. The novelty of the study is the analysis of practice in other countries and its application in Latvia, as well as the improvement of legal regulation.
