Transfer of rights arising from the contract of property insurance

Summary/Abstract: The aim of the article is to analyze the issue of the transfer of rights arising from the contract of property insurance. In this respect, the author gives specific attention to the content of art. 823 of the Civil code and art. 306–310 of the Maritime code which concern the problem of transfer of rights in the case of alienation of the insurance’s object, and the clarification of the relationship of these provisions to the general rules governing the assignment. The considerations outlined in the article concentrates also at answering the question whether and to what extent the rights arising from the contract of insurance may be transferred to the person who has not acquired the insurance’s object or to the person who does not have any other insurable interest related to the property covered by insurance.
