Summary/Abstract: The definition of collective interests of consumers present in European binding law is negative and limited to a statement that collective interests of consumers means interests which do not include the cumulation of interests of individuals who have been harmed by an infringement. This notion was criticized in the legal doctrine. In April 2018 the Commission presented a proposal of a new definition of collective interests of consumers as a part of „The New Deal for Consumers”. The proposal transfers the notion of collective interest of consumers entirely into private law, keeping it out of scope of regulatory bodies’ activity.
