GENERAL CONSIDERATIONS ON THE RIGHT TO THE ERASURE OF PERSONAL DATA

Summary/Abstract: Since natural persons should have control over their own personal data, data subjects have the right to obtain from the controller the erasure of their personal data. However in some cases the right to the erasure of personal data is not an absolute right, but it must be considered in relation to its function in society and be balanced against other fundamental rights, in accordance with the principle of proportionality. Therefore this article aims to analyse the particular situations in which the data subjects can or cannot exercise their right to erasure, without overlooking the restrictions to this right under the Romanian law.
