LEGISLATION OF THE TRANSPORT CONTRACT – THE NEW ROMANIAN CIVIL CODE AND SPECIAL RULES

Summary/Abstract: The new Civil Code (art. 1955-2008) has the value of organic law establishing general rules for the transport contract, generally applicable to all contracts in all modes of transport, the normative act trying to unify the legal relations of private law in the field of transport. The civil code has a substantial contribution regarding the transport contract, addressing the problem of the limitation period of one year, unless otherwise provided by law, the material right to action arising from a contract for the transport of goods by land, air or water, action against the carrier. The limitation period is of 3 years only in limiting cases provided by law, respectively when the transport contract was concluded to be executed successively or, as the case may be combined, with the same means of transport or with different means of transport.
