Summary/Abstract: The right to freedom of expression is one of the fundamental human rights guaranteed by international regulations and is considered one of the most important foundations of democracy and a democratic society. After the conflict in the territory of the former Yugoslavia, the process of democratization of the former republics, which is still ongoing, has begun. In this process, Bosnia and Herzegovina is very specific in its national structure and other factors that influence the process of democratization. The situation after the war conflicts endeavored to correct democratic principles, but to a certain extent, the mechanisms of democracy remained powerless to overcome nationalism and manipulation of the ruling political structures used by the abuse of the media in order to stay and survive in power. In particular, this is a case of abuse of the principle of freedom of expression that is not legally settled, and in this legal vacuum there are various forms of manipulation that negatively affect the process of democratization itself. Understanding the principle of freedom of expression and limiting the freedom of expression is at a very low level. Those who abuse freedom of expression in media houses and on social networks are mostly players of leading political entities in BiH. This fact points to the reason for the slowness in passing a law on the restriction of freedom of expression, which would aim at the progress and prosperity of society as a whole. The aim of the paper is to present the current state of abuse of freedom of expression and the ways in which such an understanding of freedom of expression affects social processes.
