Summary/Abstract: The legislative solution contained in art. 4 of the Criminal Code, which does not assimilate the effects of a Constitutional Court's decision establishing the unconstitutionality of a rule of incrimination with that of a criminal law of decriminalization, is unconstitutional. The legislative solution contained in art. 595 para. (1) of the Criminal Procedure Code, which does not contain the Constitutional Court's decision to declare the unconstitutionality of a rule of incrimination as a case of removal or modification of the punishment / educational measure, is unconstitutional.
