Summary/Abstract: The current study is dedicated to analysis of the provisions, of Law No. 84/1998 on trademarks and geographical indications2, regarding cancellation proceedings of trademark registration. There are pointed both, particular aspects of this petition for trademark cancellation and some issues that can be improved in a logical and legal way in the future regulation. Concerning the perfecting of current legal framework, the author mentions, the incorrect reference from some texts of Law No. 84/1998 towards „trademark cancellation” and useless of provisions regarding cancellation of collective marks and even of the certification marks.
