Summary/Abstract: Describing historical genesis of Serbian and Yugoslav state as well as of their pertaining national identities, the author points out to the absurdities of constitutions of the present Republic of Serbia and Federal Republic of Yugoslavia. Both these states, through basic constitutional statements, stress their “democratic” and “civil” (nationally vacant) character, and the given constitutional definition of the national sovereignty (in which there is no any criterion of the distinction between a nation and a national minority) supply pseudo-legitimity to actual authorities.
