Summary/Abstract: Since 2003 Czech courts constantly grant domain name transfer against the domain name authority and domain name holders. This praxis is based on the exercise of a delictual right to remove unlawful conduct and/or exercise of contractual right deriving from contractual relationship. Since 2009 domain name transfer against domain name holder is being granted also by Slovak courts. The aim of this article is to call the attention and open discussion among readers concerning possible problems of this interpretation.
