Summary/Abstract: According to Croatian regulations, both trade unions and workers' councils represent the interests of the workers, so their relationship should be closely linked and cooperative. There are many similarities between the trade union and the workers' council, which is why they often unfoundedly equalized. Although both workers' councils and trade unions advocate for workers' rights and interests, there are still differences between them. This paper systematizes the regulation-defined jurisdiction i.e. the rights and the obligations of trade unions and workers' councils in protecting the interests of the workers. The aim of the paper is to point to their similarities and differences in legal and legitimate concern for workers' rights. The paper seeks to emphasize the importance of the role of the trade unions and the workers' council during the growing uncertainty of jobs and salaries in the Republic of Croatia. The paper particularly emphasizes the role of trade union commissioners in companies where workers have not yet consumed the legal right to found a workers' council.
