Summary/Abstract: The first part of the paper was about the separation of powers, and the relationship between the legislative and the executive, particularly from the point of view of Slobodan Jovanović, one of the most famous law theoreticians in our history. Also, we discussed the presidential and parliamentary systems, as well as the relationship between the legislative and the executive in the United Kingdom and the United States of America, as the most eminent representatives of these systems. In the central part of the paper, we briefly analysed functions of parliament. The major accent was on the scrutiny of the parliament, perhaps the most important parliamentary function, especially at a time when the government has a great deal of power. In addition, we largely dealt with defining parliamentary questions and interpellation in national and comparative law theory. In the end, we considered the nature of the relationship between the legislative and the executive in modern parliamentary systems, but we also pointed out the most relevant inconsistencies of current norms in Serbia related to parliamentary questions and interpellation.
