Summary/Abstract: The decision refers to a very important procedural problem which is the questioning. This activity is confused with a classic interrogation. However, the main problem is how to capture and introduce this type of evidence into the process, while respecting the content of art. 174 k.k. The author has analyzed the jurisprudence and presented the doctrinal view of the title problem.
