Summary/Abstract: The paper describes State practice and law of nuclear deterrence from the perspective of right of self-determination and sovereign equality of States. Definition of nuclear deterrence is presented as well as its legal basis under contemporary international law. Both principles of the Charter of the United Nations are defined as well, based on selected treaties, judgments and advisory opinions of the International Court of Justice and both Security Council and General Assembly resolutions. The analysis includes a case-study, referring to practice and legal justification of nuclear deterrence by the Democratic People’s Republic of Korea.
