The enterprise forfeiture as a manifestation of lacking legislator’s rationality

Summary/Abstract: The publication deals with the problem of enterprise forfeiture as a form of criminal law measure. It is a new form, introduced in 2017 as a basic instrument against organized economic crime in Poland. An analysis of the provisions of the Criminal Code, in which it is regulated, leads to the conclusion that the provisions contain numerous errors. Hence, the conclusion that this solution is a manifestation of lacking legislator’s rationality.
