Summary/Abstract: In the Russian criminal trial the defense attorney plays a special role. As an active participant in the process of proof, the defender provides evidence to support his thesis. Negative and positive Russian experiences, when it comes to the so-called attorney investigation has a practical value. In the article, the author describes the legal solutions applied by the Russian legislator, shows its advantages and criticizes certain defects.
