Circumstances excluding criminality for actions in destroying an aircraft with the goal of precluding the illegal use of airspace or a terrorist act: Experience of the Russian Federation

Summary/Abstract: In this article, the author considers, on the basis of regulatory and doctrinal sources, the circumstances excluding criminality for actions that may be relevant in the event an aircraft is destroyed in accordance with Article 7 of the Russian Federal Law “On Preventing Terrorism”. This regulation is analysed in the context of self-defence, extreme urgency, the execution of an order, and other institutions criminal law.
