Summary/Abstract: The question of consent to participation at medical experiment of partially legally incapacitated person creates problems concerning interpretation of the statute law, which are a result of lack of appropriated regulations in Act on Doctor and Dentist Professions. The analysis of this issue brought to followed conclusions: first, the partially legally incapacitated person can give her/his consent only to the medicinal experiment, but not to the research test. Secondly, participation of the partially legally incapacitated person in medicinal experiment requires only the consent of this person. The consent of the statutory representative is not required.
