Summary/Abstract: The European Council defined in 1999, in Tampere, the principle of mutual recognition in the criminal justice cooperation plan, yielding significant progress on this basis. The most important element of progress in mu-tual recognition was achieved through the Council Framework Decision of 13 June 2002 on the European arrest warrant, which entered into force on 1 January 2004. This decision makes possible the arrest and transfer of suspects between EU Member States without formal extradition proceedings, eliminating political interference in the process. But this is just a facet of the issue of the way in which justice and home affairs are displayed and implemented in the European Union's administrative area. The evolution of the process of European integration is also due to the advanced policies in the field of justice and home affairs (JHA) of the EU for the area of freedom, security and justice area (AFSJ). Therefore, the purpose of the paper is to describe the contribution of the evolution of the JHA field to the gradual integration of national structures into the EU by identifying the need for rallying at the AFSJ.
