Summary/Abstract: The report analyzes the hypothesis of a conflict between EU Law and the national (constitutional) identities of the Member States over the issue of transnational recognition of same-sex marriages. Special emphasis is put on ECJ's decision in the Coman case (C-673/16), in which the Court postulated that the notion of "spouse" within the meaning of Directive 2004/38 is "gender-neutral".
