Surrogacy and Maternity Leave

Summary/Abstract: Author in the present article deals with the issue of surrogacy. At the beginning of his article captures the essence of surrogacy and points on its forms. Subsequently it characterizes the conditions for entitlement to maternity leave and maternity benefit, while continuously passes to the analysis of relevant case-law of the Court of Justice of the European Union and the Slovak courts. At the end of the article author summarizes the collected knowledge arising from the case-law and with reference to selected labor and socialsecurity aspects of surrogacy justifies the adoption of legislative measures, which would modify the selected legal aspects of surrogacy.
