The Civil Code Provisions of Lease Suitable for a Technical Amendment

Summary/Abstract: In this article, the author focuses there on the civil code provisions of lease which are wrong, in his opinion. This provisions are for example Sec 2202 para. 1 the second sentence CC, Sec 2252 CC and Sec 2281 para. 1 the second sentence CC. In this article, the author indicates the inaccuracy of these provisions and he explains the reasons leading to this conclusion. Finally, the author proposes how to correct the mistakes.
