Summary/Abstract: The article focuses on the basic principle of superficies solo cedit and its return to the Czech legal system. The main emphasis of this thesis is based on the analysis of the transitional provisions of the Czech Civil Code, which deal with the mentioned issue. In this thesis the approach of the Czech legislator is compared with the similar legislation and legal approach that has been used in the nineties of the 20th century in Germany. Through this comparison the author comes to the conclusions (also critical) about the level of suitability of the chosen measures and suggests possible solutions to some of the problematic aspects. In this regard, she focuses in particular on the right of construction and pre-emption right.
