Proceedings regarding medical incidents

Summary/Abstract: Medical incident is a negative phenomenon both in the area of medical activities performed by authorized entities as well as in the processes of creating medical products by its producers. No medical product gives full guarantee both of its effectiveness in the therapeutic process, as well as in achieving only the positive results to the therapy. There are cases where in addition to the primary purpose for which the product was created and subjected to use, a negative phenomenon appears in terms of health and human life – it can form a so-called medical incident. Those are the subjects of administrative opposition which is the purpose of using appropriate normative instruments. This study, based on descriptive method, is a presentation of ways and efforts eliminating the phenomenon’s of such incidents in a form of legally organized series of activities of which the most radical form is the withdrawal of a defective medical product from the market in the broadly understood area of medical activities.
