Overview of the decisions of the Polish Supreme Court

Summary/Abstract: The Polish Supreme Court settled the dispute regarding significant doubts as to the term “predominant activity” referred to in the Act of retail trade limitation on Sundays and holidays and on some other days. The court ruled that it is an activity a combined trade of the press, tickets for public transport, tobacco products, coupons for games of chance and betting, as well as an activity which offers only one of the products listed in that Act. In addition, the Supreme Court ruled on the inadmissibility of securing claims by being placed in the National Center for the Prevention of Dyssocial Behavior. In pending proceedings, pursuant to the Act of 22 November 2013 on the treatment of persons with mental disorders posing a threat to life, health or sexual freedom of other persons, the provisions of the Code of Civil Procedure on proceedings to secure claims shall apply accordingly. However, it is unacceptable to secure claims by placing the person concerned in the National Center for the Prevention of Dyssocial Behavior.
