Summary/Abstract: The rapid progress in technology and in the field of electronic data processing has radicalized the conventional handling of personal data, leading to increasing risks and vulnerabilities. In the same sense, the landscape of the medical business environment in Romania and the whole healthcare ecosystem is rapidly transforming with the digitalization of the society.It is an unchallenged fact that such risks may have a significant effect on the fundamental rights and freedoms of the patients.Aspects concerning the confidentiality of health data or access to personal medical data are high risk areasbecause malpractice can occur not only in the scientific part of the medical practice, but also in the ethical component of medical practice wherecan be determined by failure to comply with the non-ethical principles applicable to medical activity “civil liability of the medical personnel for damages arising from the failure to comply with these title regulations on the confidentiality or informed consent”.In this context, the GDPR provides the grounds to process such data in the area of health and healthcare management and the medical institutions will have to work hard to provide the public and patients with clear and accurate information relating to how their personal information is used.This is a work in progress.
