General considerations on the implementation of Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 /EC in the local public Admin

Summary/Abstract: The way of processing personal data, so that it is protected, is a common concern for both central public authorities and local public authorities in Romania.Although Regulation (EU) No. 679/2016 came into force on May 25, 2016, in Romania, this document made his presence more intense after May 25, 2018, when applied. The paper presents the legal framework for the protection of individuals from the processing of personal data, the essential conditions for the implementation of the GDPR in the local public administration as well as the monitoring of this aspect by ANSPDCP and DPO. It also proposes that the local public administration pass from the current bureaucratic system, more complex from one administrative-territorial unit to another, to a uniformly digitized system that by means of its instruments and techniques can ensure respect for the fundamental rights and freedoms of individuals processing of personal data within the European Union as well as the free movement of such data.
