First decisions of the International Tribunal for the Law of the Sea : [case review and comment]

Summary/Abstract: The first proceedings before the International Tribunal for the Law of the Sea in Hamburg were initiated on 13 November 1997 in the event of a sailing ship ''Saiga''. The Flag State of Saint Vincent and the Grenadines has submitted to the Tribunal a request for the immediate release of the ship and its crew, citing Article 292 of the 1982 UN Convention on the Law of the Sea. All judges, twenty-one, adopted on 4 December 1997 a unanimous decision that the Court was competent to deal with the case. Voting 12: 9 The Court ruled that the request was acceptable and that the ship and its crew should be urgently released, subject to a reasonable deposit or other financial guarantee. At the request of St. Vincent and the Grenadines, on 1 March 1998 the Tribunal issued a decision on the imposition of provisional measures under Article 290 of the Convention.
