Jurisdiction of the coastal state with regard to the protection and preservation of the marine environment in the exclusive economic zone

Summary/Abstract: This paper deals with rights and duties which the Law of the Sea Convention accords to the coastal state for the protection and preservation of the marine environment in the exclusive economic zone. Although all states enjoy the freedom of navigation in that maritime space, the coastal state may adopt and enforce laws and regulations for the prevention, reduction and control of pollution from vessels. The national regulations have to be made in accordance to international rules and standards established through the competent international organization (lMO) or general diplomatic conference. The coastal state, after appropriate consultations through the IMO with other states concerned, may for particular, clearly defined area within the limits of the exclusive economic zone, adopt additional regulations necessary for their effective ecological protection. Also, dumping within the exclusive economic zone shall not be carried out without the express prior approval of the coastal state, which has the right to permit, regulate and control such dumping. An analysis of these provisions is made in the light of their application in the ecological and fisheries protection zone of the Republic of Croatia.
