Summary/Abstract: The public lending right is one of the economic rights granted to copyright and related rights holders, and for authors of written works, represents one of the most important remuneration possibilities for the use of their works in the libraries. The Directive on rental right and lending right and on certain rights related to copyright in the field of intellectual property is currently the only supranational act on lending, establishing the specific copyright legal framework for the recognition by the Member States of the lending right for authors and other rightholders. In Romania, not even more than 14 years after the implementation of the Directive, the public lending system is not functional because the provisions of the Directive have been incorrectly transposed in the Law no. 8/1996, exempting from payment of the equitable remuneration the libraries in all educational institutions and all the public libraries with free access. In this regard, the article presents the systems implemented in the European Union and at international level on the public lending right.
