Councils for the National Security and Defence According to the Comparative Constitutional Solutions

Summary/Abstract: In this paper the solutions on councils for national security and defence are analysed and mutually compared in new constitutions of 25 European, Latin-Americans, African and Asian countries applying comparative legal method. The goal of this analysis is to find in which scope these bodies are defined in the constitutions and how the questions of theirs position, role, competence and composition are arranged. Additional scope of the analysis is to contribute eventually to the choice of the model which could be used for the creation of the new solutions in the Serbian constitution. Results of analysis demonstrate that in the half of the 50 reviewed constitutions, these bodies are defined in detail or with few rules, and they are mostly advisory bodies of the state president, rarely of the government. Beside the advisory or coordinating role, these bodies in few number of cases have authority to suggest, control or decide. These bodies are usually constituted by the chiefs of the authorities and security forces, and in many examples by the representatives of the parliament. Results of the analysis are compared with the legal solutions on Council of national security of the Republic of Serbia, and in conclusion, besides summarizing the results of analysis, and is pleaded for the constitutional regulation of this body in Serbia.
