Summary/Abstract: In analyzing some controversial postulates and specificities of the fundamental concepts of the philosophy of the state and politics, the author attempts to identify the points of departure in Hegel's articulation of a scheme of the science of the state. The concept of the modern state is deduced through a systematic review of the historical evolution of the idea of freedom in the substantial context of law, morality and custom. The reconstruction of custom, the dialectic mediation of the divorced spheres of practical life is opposed in principle to the methodical construction of the state and the society in modern social philosophy. It is in this opposition that the formalism of the methodological positing of custom totality — the scientific state, is broken down; the state is founded along the horizon of the historical experience of practical consciousness. The prime concern, according to Hegel, is to reconstruct adequately the substance of custom which lies at the basis of the historical world of life.
