Summary/Abstract: This article discusses the issue and the legal framework in cases of parental refusal to have his/her child travel abroad with his/her other parent. The European Union practice on the subject is considered, as well as the preconditions that led to the legislative initiative on the adoption of Art. 127a of the Family Code and Interpretative Decision No 1 of 03.07.2017 of the General assembly of a civic college of the Supreme Court of Cassation. The case law on the subject is also examined
