Nature of the mediation clause in contracts concluded with consumer

Summary/Abstract: The Mediation is an alternative means of disputes resolution that has recently developed in consumer affairs. As stronger parties have no opportunity to use the arbitration clauses in consumer contracts, they started to use the mediation clauses in practice instead. Given the fact that the so-called mediation clauses are not – unlike the arbitration clauses – restricted by law, the question is whether such arrangements in consumer contracts are possible or not.
