Summary/Abstract: The article discusses the question of international jurisdiction for actions under Article 5 (3) of Council Regulation No 44/2001 of 16 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. It discusses the problem of where the jurisdiction over which the damage occurred when dealing with so-called indirectly injured parties. The author is of the opinion that the injured relatives of an accident victim can assert their claims only at the scene of the accident or at the domicile of the defendant, but not where damage has been caused to them.
