Withdrawal of the obligation by transmission the property of a immobile good in order to clear the debt

Summary/Abstract: For the execution of an enforceable title, any property belonging to the debtor with the right of private property can be traced, except for the assets that can not be traced. It is necessary to mention that in the execution procedure, the assets belonging to the debtor, both movable and immovable, the money means, the securities, the patrimonial rights of the debtor, can be attributed to the property category. The present study analyzes the steps of tracking assets, seizing, lifting and selling, as well as how to waive the obligation to pay by transmitting to the lender the ownership of the immovable property pursued.
