Summary/Abstract: The prohibition on corporal punishment by persons executing custody and/or guardianship of a minor is expressed in the article 961 of the Family and Guardianship Code. It is necessary to answer the question whether – due to the introduction of the aforementioned prohibition, in the current state of law, a parent punishing a child by so-called “spanking” runs the risk of criminal responsibility for the crime of infringing personal inviolability, i.e. for an offence against article 217 of the criminal code. The doctrine proves that such a behaviour constitutes beyond doubt such a prohibited action. In the light of the regulations discussed in the article, one must conclude that in abstracto such an action is lawless and punishable.
