Summary/Abstract: The case law of Luxembourg Court has held that EU legal system is different from the legal order of the Member States and, respectively, of the international legal order. Based on the issues discussed by the legal literature and case law of the EU Court of Justice, the paper seek to provide an overview of the obligation to apply the European law in the national law of the member states, paying particular attention to issues regarding the extinguishment of the obligation to apply EU law and to certain related matters.
