Summary/Abstract: The question referred for a preliminary ruling concerns the interpretation ofprovisions of EU law which apply in a specific case before a court of a Member State.The aim of the preliminary ruling is to eliminate inconsistencies between theconsequences of Member State law and European law. In accordance with the principleof the primacy of EU law, the national court, in the event of non-compliance of EU lawwith national law, applies the laws of the EU.
