Summary/Abstract: The article presents the conditions and use of the representative democracy instrument in the European Union, which is the European Citizens' Initiative. The starting point of the considerations is the presentation of legal requirements regarding the submission of the initiative, but the main part refers to the presentation of the practice in this respect and attempts to assess factors that directly affect the effectiveness of using this legal instrument. In this context, a thesis was put forward that the current legal regulations do not give citizens the possibility of real impact on the European Commission in submitting a legislative proposal, and the mobilization and activity of European Union citizens are not effectively used.
