Summary/Abstract: The article involved consideration of the inexperience, inefficiency or forced situation of a partner in a partnership in case of entering into a partnership deed and partnership operation in the course of business. Among others, for this purpose the influence of the situation in which a partner is present in the case of one-person, joint and contractual representation was analyzed. It has been assumed that exploitation is a defect of the declaration of intent, which implies that the discussed states can only be combined with natural persons. It was found that a partnership, as a participant in business transactions, can be perceived as both exploited and exploiting party.
