The decisions of the Stalinist justice of the 50’s produce effects by E.O. no. 31/2002, amended by law 217/2015

Summary/Abstract: In a confusing political context, in 2002, the Government issued the Emergency Ordinance no. 31, aiming, as the title shows, to ban fascist, racist or xenophobic organizations and symbols and to promote the cult of persons guilty of committing crimes against peace and humanity. In this study we analyze the offense of publicly promoting the cult of persons guilty of committing genocide, humanity and war crimes, as defined in the first part of art. 5 of the Ordinance, in the form gained after the amendments brought by Law 217/2015.
