Summary/Abstract: The human rights are and will be an essential characteristic of the democratic states that support the proper affirmation and development of the human being. The first forms of human rights violation are the unlawful deeds, that are apparently small infringements (trespassing) but which, in case they are not properly punished, will lead, as practice showed, to perpetration of penal offences. A more important and responsible approach of the way this type of deeds are dealt with, together with the propositions of lege ferenda can be a first step towards the breaking of law limitation.
