The right to the Court in the case law of the Polish Constitutional Court and the European Court of Human Right

Summary/Abstract: The article focuses on the main issues identified by the European Court of Human Rights and the Constitutional Tribunal in regard of implementation of the law and access to the court in civil proceedings. Further discussed issues include financial obstacles as well as excessive lenght of these proceedings. we also proposedseveral legislative actions that could contribute to imporving this situation.
