Summary/Abstract: It is important that according to the Church property law, the special agreement – alienation, needs special attention. Undoubtedly this institution constitutes the example of the mutual of the two laws – canonical and secular. Characteristic regulations were entered into in the 1983 Code of Canon Law, which in case of the lack is sending back to the regulation on given territory. Legislator regulating the institution of the alienation pointed at essential activities, which one should carry out so that it was important and depended them of the value of alienated thing. To most important from them ranked the agreement of the competent authority. The non-execution of any of conditions results in the invalidity of the agreement, even it complies with the requirements of the civil law.
