Summary/Abstract: For centuries the child was seen as a gift from God to the family. In recent decades the child has also become a commercial commodity that can be bought. This paper aims to show how maternity can also be seen from the commercial perspective. The procedure of using a surrogate mother is due to the fact that more and more women can not give birth to their own children without the help of others. Unfortunately in such cases, maternity is increasingly seen as satisfying desires for parenting regardless of the consequences. The procedure of using surrogate motherhood also takes place in cases of homosexual couples. Different legal regulations in different countries focus on the right of a woman to have a child (also at any cost). There are also countries where the child’s right to own real parents is respected. The new concepts of terms: wrongful birth action and wrongful life actions are used in the jurisprudence and American legal doctrine. The rights and obligations of the surrogate mother to the biological parents are also mentioned. The article also remarks the important aspect of a person’s psychological connection to a baby during pregnancy. Always ask questions: What is the real price of having a baby? What kind of emotional sensibility has a child who actually has several parents? Can legal regulations be separated from the moral principles of the child psychology? Is the child here an individual human being or just a commercial subject?
