THE RIGHT OF RETENTION OF THE LESSEE

Summary/Abstract: The work is devised in two sections, the first dealing with general aspects of the right of retention, namely the notion, the legal nature and the subjects of the right of retention. Section II examines the lessee's right of retention, with particular reference to the establishment of the right to the date of meeting the two requirements, namely the right of restitution of the given property for the lease and the performance of the works by the lessee. The work continues with the analysis of the conditions of the invocation of the right of retention, in the end to highlight the situations in which the right of retention is extinguished.
