PROVISIONS ON TRADE UNION SECURITY

Summary/Abstract: The freedom of trade union organization involves two possible directions: positive (related to establishing associations and admitting membership) and negative (related to not being member of any association). Despite its undeniable significance in modern law, the freedom of trade union association is restricted. One of these restraints regards the provisions on trade union security, which are the subject matter of this paper. On exposing the problems, the author provides the most significant forms of these provisions and makes a contrastive analysis of the related legislation in a number of comparative legal system. In the last part of the paper, the author discusses the justification of the provisions on trade union security both from the point of view of the trade unions7 interest and from the point of view of the employees' right not to be members of a trade union, including a critical review of both aspects.
