CONTRAVENTIONS TO THE LEGAL REGIME OF FUNERAL SERVICES THAT ARE NOT SANCTIONED WITH THE ANNULMENT OF THE OPERATING SANITARY PERMIT (I)

Summary/Abstract: The Romanian Decision no. 741 from the 12th of October 2016 regarding the implementing rules of the Law on cemeteries, human crematoriums and funeral services incriminates certain facts which are punishable as contraventions. As such, this short overview has as primary objective the identification and presentation of some facts considered by the current legislation as being contraventions to the legal regime of funeral services. Our interest concerns not all the facts considered contraventions, but only those which are not sanctioned with the annulment of the operating sanitary permit of the funeral service provider. As secondary objective, we'll put forward some de lege ferenda proposals destined mainly to clarify and reinforce the legal framework of funeral services.
