Summary/Abstract: The unsecured creditor, holder of a certain, liquid and payable claim, after sueing out revocation of the unlawful act on the strength of which the tracked property has been alienated, may at any time proceed or resume compulsory execution against the debtor, citing successfully this case of freezing limitation progress of claiming compulsory execution, while the mortgagee may claim or resume compulsory execution against the debtor, case in which freezing limitation progress of claiming compulsory execution provided for in Article 4051 para. (1) letter c) in the Civil Procedure Code is not applicable.
